OOHNA Healthcare Services Professional Liability and Commercial General Liability Insurance Program

Marsh Canada is pleased to advise that the Limit of Liability for each of the OOHNA Insurance Program’s General Liability and Healthcare Services Professional Liability insurance is $2,000,000. Furthermore, the annual premium for these $2,000,000 coverage limits is $200 for this term. OOHNA members also have the option to increase the limit for these coverages to $3,000,000 for an annual premium of $240 or $5,000,000 for an annual premium of $260.

The Ontario Occupational Health Nurses Association (OOHNA) is pleased to provide its members with access to an exclusively sponsored insurance program — coverage which the vast majority of OOHNA members choose to purchase. Under this program, the OOHNA member is insured while practicing as a Nurse as defined by the College of Nursing in the province or territory in which they are working. This insurance offering meets and exceeds the coverage requirements as specified by the College of Nurses of Ontario.

While OOHNA members have been benefiting from access to this insurance program for many years, it is important to note that coverage is also available to all Registered Nurses in Ontario as well as any Registered Nurse working in any province or territory in Canada. OOHNA membership is available to all Registered Nurses in Canada.

This insurance program is brokered by Marsh Canada Limited and underwritten by Aviva Insurance Company of Canada.

Program Highlights
  • The 2016-2017 annual premium for the OOHNA Insurance Program has been reduced by $40 from the previous year to $200 for a $2,000,000 coverage limit. In addition, OOHNA members have the option to increase the limit of coverage to $3,000,000 for an annual premium of $240 or $5,000,000 for $260. The OOHNA member will be insured while practicing as a Nurse defined by the College of Nursing in the province or territory in which they are working. Please note that the OOHNA Insurance Program includes coverage for both Healthcare Services Professional Liability (PL) and Commercial General Liability (CGL).
  • The standard CGL Limit has been increased to $2,000,000 for:
    • Bodily or Mental Injury and Property Damage Liability.
    • Personal and Advertising Injury Liability.
    • Tenants Property Damage Liability.
    • Voluntary Medical Payments.
    • Non-owned Automobiles and Legal Liability for Damage to Hired Automobiles.
    • Employee Benefits Errors and Omissions.
    • Voluntary Compensation Form.
  • Please note that you have the option to increase the CGL Limit to $3,000,000 or $5,000,000. There is no Property Damage Deductible.
  • The PL portion of the policy has a $2,000,000 Limit for Punitive Damages Claims made during the policy period each occurrence with a $4,000,000 Annual Aggregate.  The Punitive Damage Limit is part of, not in addition to, the combined PL and CGL Limit.
  • The combined PL and CGL policy provides coverage for all activities that fall within the definition of Nurse by the College of Nursing in the province or territory of the OOHNA member, subject to the Policy’s terms and conditions. This includes back to work claims adjudication.
  • Coverage for Non-profit Healthcare Organizations Directors and Officers Liability and Outside Directorship Liability is provided up to the selected combined PL and CGL Limit. Please note: This insurance is a on a claims-made form and has important reporting requirements in the event of a Claim.
  • The CGL Products and Completed Operations Limit of Liability has been increased to $2,000,000 per Occurrence with an Annual Aggregate of $4,000,000; compared to the previous program limit of Liability of $1,000,000 per Claim and Annual Aggregate.
  • Legal Expense is covered on the under the PL portion of the Policy with a $50,000 per Claim Limit and a $250,000 Annual Aggregate. Please note: This insurance is a on a claims-made form and has important reporting requirements in the event of a Claim.
  • The Tenants Legal Liability Limit under the CGL portion of the Policy will be the same limit as the selected combined PL and CGL coverage Limit.
  • Voluntary Medical Payments coverage under the CGL portion of the Policy is $25,000 per person and $100,000 per Occurrence. Please note there is a $1,000 Deductible.
  • Employee Benefits Errors and Omissions coverage under the CGL portion of the Policy has a limit of $1,500,000 per Claim and $1,500,000 Annual Aggregate. Please note: This insurance is a on a claims-made form and has important reporting requirements in the event of a Claim. There is a $1,000 Deductible.
  • The Voluntary Compensation Limit for Employee Bodily Injury under the CGL portion of the policy will be the same as the selected combined PL and CGL coverage Limit. Please note there is a $1,000 Deductible.
  • The Non-owned Automobile Third Party Liability Limit under the CGL portion of the Policy will be the same limit as the selected for the CGL coverage Limit. The Legal Liability Limit for Damage to Non-Owned Automobile is $100,000 with and a $1,000 Deductible.
  • OOHNA Volunteer Workers that are Canadian Residents are insured under the Voluntary Compensation coverage to the Limits of the combined PL and CGL policy.
  • The Aviva Policy for the OOHNA Insurance Program is issued on an Occurrence Form (except for the Employee Benefits Errors and Omissions, the Directors and Officers including Outside Directorship, and the Legal Expense coverages). For incidents the insurance policy covers, Claims will be honoured for injuries sustained during the life of the Policy, even if the Claim is filed after the Policy has been cancelled. An Occurrence is an event that can result in the filing of an insurance Claim.
  • The Employee Benefits Errors and Omissions, the Directors and Officers including Outside Directorship, and the Legal Expense coverages are issued on a claims-made form, which responds if the claim is made during the Policy Period. The “Wrongful Act” or Claim is discovered when given notice that a “Wrongful Act” had been committed. Notice can be written or verbal demand or claim for damages. The insured must report this claim during the same policy period that notice was given. Failing to report the claim during the period that it was discovered in will result in a denial of the claim.

Q. Do I have to be an Ontario Occupational Healthcare Nurses Association (OOHNA) member to enrol in the OOHNA insurance program?

A. Yes. Membership in the OOHNA is required to participate in the OOHNA Insurance Program.

Q. What are the types of coverages included under the OOHNA Insurance Program?

A. The OOHNA Insurance Program includes coverages for Healthcare Services Professional Liability (PL) coverage and Commercial General Liability (CGL) coverage.

Q. What does your PL coverage include?

A. The PL portion of the policy includes:

  • Continuous coverage in the rendering of Registered Nursing and Occupational Health Nursing services including opinions and/or counselling as defined by the College of Nurses of the province or territory where they are practicing.
  • Back to work claims adjudication, clinical case management, and disability case management services which were rendered or should have been rendered by the insured in the practice of the profession of Registered Nursing and Occupational Health Nursing.
  • Coverage for Punitive Damages to the limit shown on the declaration page.

A. Available limits are:

  • $2,000,000 Limit for each occurrence with an option to increase to $3,000,000 or $5,000,000 for the policy period.

Q. What are the combined available Limits for PL and CGL under the OOHNA Insurance Program?

A. The standard combined PL and CGL coverage Limit under the OOHNA Insurance Program is $2,000,000 for each occurrence with an option to increase to $3,000,000 or $5,000,000 for the policy period.

Q. What are the insured’s obligations in the event of an incident or Claim for either PL or CGL?

A. The “Named Insured” must notify the insurer or Claims representative as soon as practicable of any “Occurrence” or offence which may result in a Claim against the insurance. The Notice should include to the extent possible, but not be limited to:

  • How, when, and where the “wrongful act” took place.
  • The names and addresses of any affected persons, organizations, and witnesses.

Q. What happens if I am sued? 

A. If a Claim is made or an “action” is brought against the insured, the “Named Insured” must contact the Marsh Canada Limited Claims Department for more information.

Q. What happens if I retire?

A. If you plan on retiring in 2017 or later, the CGL and the PL policies, under the OOHNA Insurance Program, are both on an occurrence form that will cover Claims made for injuries sustained during the life of the policy, even if the Claim is filed after the member has retired. There would be no additional cost for this coverage.

Q. What is the PL coverage for disciplinary actions?

A. Coverage for disciplinary actions includes Legal Expense coverage that provides:

  • Coverage for legal expenses which an insured member incurs for representation by a lawyer for conference, counselling, investigation, preparation of documents and transcripts, and witness fees — while under investigation or when called upon to appear before a disciplinary committee formed by virtue of any provincial act or before any court called upon to adjudicate any infraction envisioned in the said act(s).
  • Limit per member of $50,000 per Claim with an Annual Aggregate of $250,000 reported during the policy period for reasonable fee incurred by the insured. The total “legal expense” incurred must be reported within 180 days of completion of the proceeding.

Q. Are there any other important notes?

A. Yes, please note:

  • Coverage under claims-made and reported policies – Under the PL policy, the Legal Expenses coverage and Directors and Officers coverage including Outside Directorship are on a claims-made form. Under the CGL policy, the Employee Benefits Errors and Omissions coverage is also on a claims-made form. Any incidents or Claims that you become aware of during policy term need to be reported promptly to your broker/insurer while the policy is active.
  • Prior knowledge of Claims before you became an insured member is not covered - This means if you were aware or should have been aware of Claims, in view of the facts, because of obvious circumstances prior to you becoming insured under this program, these Claims are not covered irrespective of whether they are reported during the policy period.
  • Defence costs are in addition to policy limits - This means that your limit of liability will not be reduced by defense costs.
  • Retroactive Date - The Retroactive Date is applicable to the PL policy coverages for Nonprofit Directors and Officers Liability and Outside Directorship Liability only. No other coverages on the policy have a retroactive date.
  • Deductibles:
    • PL coverages - No Deductible.
    • CGL coverages - $1,000 Deductible for each of: Non-owned Automobile SEF 94 Legal Liability for Damage to Hired Automobiles, Employee Benefits Errors and Omissions, Employee Bodily Injury, and Voluntary Medical Payments.
